This Privacy Policy & Cookies Notice (“Notice”) describes how Bragg Live Food Products, LLC (hereinafter “Bragg”, “we”, “our”, or “us”) collects, uses, and discloses information about you when you access or use any portion of our website and the information and services made available to you when you visit our website (the “Site”). The types of information we collect depend on how you use our Site. We may update this Notice at any time, and we will indicate at the top of this page the date it was last revised. By using the Site, you agree to the collection and use of your information in accordance with this Privacy Policy and to be bound by our Terms of Use Agreement, which you can view here. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meaning as in our Terms of Use Agreement. It is your choice to voluntarily use and access the Site. Do not use and access the Site if you do not expressly consent to the terms, conditions and notices contained in the Privacy Policy and in the Terms of Use Agreement. By using the Site, you acknowledge that have reviewed and acknowledged the terms and notices contained in the Privacy Policy and in the Terms of Use Agreement. By choosing to voluntarily use and access the Site, you further acknowledge and agree that the information you submit on the Site is used for legitimate ordinary business purposes. You further acknowledge and agree that the information you voluntarily submit on the Site is used to carry out legitimate business purposes in accordance with this Privacy Policy.
Types of Information Collected by Bragg
The most common information we collect is the information you provide us. For instance, when you create an account with us or contact us through the online portal provided on our Site to ask questions or subscribe to our newsletter, we ask you to provide certain personal information, such as your name, company, email address, location, and other contact details. If you contact us by phone, email, social media, or by some other means, we may keep a record of that correspondence and any information that you submitted in connection therewith. When we send you emails, including newsletters, we may also track if you open them. We may also collect other content and information you share by commenting on or participating in online forums and similar social media communities, or when you otherwise interact with us by any other means. If you want to purchase our products from the Site, it is our policy to redirect you to a third-party merchant. The Site may ask you to enter information about your location in order to direct you to the retailer nearest to you. Or the Site may direct you to a third-party online retailer. Please refer to those third-parties’ privacy policies and terms of use to learn more about their privacy practices, which we do not control. You may also purchase our products over the phone with one of Bragg’s customer service representatives. The phone representative may request certain personal information in order to complete the transaction, such as your name, company, email address, shipping address, phone number and other contact details. They may also request payment information, such as your credit or debit card number or your bank account number in order to process payments from you or to remit payments to you in connection with your purchase. When you make a purchase or return, we collect information about the transaction, such as product details, purchase price, and date and location of the transaction.
We (and our service providers) may collect information about how you use and interact with the Site using various technologies, such as cookies or web beacons. A cookie is a small text file that any website, including ours, places in your internet browser to save your preferences. We may use cookies to collect information about your location, your browser, when you accessed the Site and for how long, the website address that linked you to our Site, and the website you visited after leaving our Site. We may also use cookies to share information with other websites, media partners and social networks in order to offer you pertinent promotional and adverting communications that match your interests (third party cookies). Bragg may use a video (“Video”) from a third-party website or third-party service provider. Use of this video feature may be shared with third parties for the purposes outlined in this Privacy Policy, in accordance with applicable law, including for marketing and analytics. We use tracking technologies throughout our Site, including Meta pixels, and your viewing information of any such Video is subject to being collected, shared, and stored in accordance with this Privacy Policy and the privacy policy of our service providers, like Meta or Google. Your use of this feature constitutes your consent to such action, including but not limited to the consent required by Penal Code sections 632 and 631. If you do not consent, do not watch Videos on the Site. Your consent to this Privacy Policy followed by your voluntary access of and viewing of a Video on our Site represents your consent and agreement to any information collected, shared, and stored as a result of your viewing of and access of the Video.
Bragg may enable a live chat feature (“Live Chat”) administered by a trusted service provider on the Site. By voluntarily participating in the Live Chat, you consent to the recording and sharing of your conversation for the purposes outlined in this Privacy Policy, in accordance with applicable law, including for marketing and analytics. If you do not consent to the recording or sharing of your conversation as outlined in this section, please do not use the Live Chat feature. Your use of this feature constitutes your consent to such action, including but not limited to the consent required by Penal Code sections 632 and 631. If you do not consent, do not utilize the Live Chat feature on the Site. Your consent to this Privacy Policy followed by your voluntary use of this Live Chat feature on the Site and your voluntary submission of information on the Live Chat feature on the Site represents your consent and agreement to any information collected, shared, and stored as a result of your use and access of the Live Chat feature.
This Privacy Policy gives you express notice of and explains how we use cookies and the choices you have. Except as otherwise stated in this policy, the Privacy Policy will apply to our processing of the data that we collect via cookies. When and Why Bragg May Use Your Information

We cannot control or be held responsible for third parties’ privacy practices. Please note that if you choose to remove or reject cookies, this could affect your use of and the functionality of our Site. Further, we only want to communicate with those who want to hear from us. You have the right to unsubscribe from our emails and newsletters at any time by simply clicking the designated “unsubscribe” link. If you would like to delete, update or correct your email address, mailing address, phone number or other contact information you provided us, please contact us at privacy@bragg.com. Requests to remove or update your contact information may take up to fifteen business days.
Storage of Data
We may store data until it is no longer necessary. This determination is made on a case-by-case basis and depends on the nature of the data. For example, it may be necessary to store personal data regarding pending or future legal disputes, or for things like maintaining and improving our Site and our products, or for keeping our systems secure, or for maintaining appropriate business and financial records. Personal data contained in contracts, documents, notifications and other business correspondence may also be subject to statutory storage obligations depending on the law in the applicable region.

Our Site may contain links to websites operated and maintained by third parties, over which we have no control, including social media websites hosted by third-party providers. However, this Privacy Notice only addresses Bragg’s collection and use of your information, if any. Your access to such third-party websites is solely at your own risk. The Global Distribution of our Products
We have authorized distributors located outside of the United States. Your information may be transferred, transmitted to, stored, or processed in the United States or other areas located outside your country as necessary for us to provide our Products to consumers throughout the world. We may utilize third-party platforms, domains, and other third-party service providers located outside your country to assist us in the global promotion, sale and distribution of our products. We carefully select business partners that have effective security measures and safeguards in place, however you should consult their terms of use and privacy policies, which we have no control over, to determine how they collect and use data. Because some recipients of your personal data are located outside your country, please note that protection laws may provide a different level of protection than the laws in your country.
Your Privacy Rights
In those countries where we are required to do so by law, you may have the right to be informed as to how and whether your personal data is being collected and obtain a copy thereof, and in some cases, you may have the right to request erasure of your personal data. Supplemental Privacy Statement for California Consumers
If you are a California consumer, the information below also applies to you and supplements the terms of this Notice. If you are a California consumer and current or potential employee of Bragg, this Notice and these additional terms are further supplemented by Bragg’s internal employee privacy policies, which are not disclosed herein. Certain terms used in this section have the meaning given to them in California Civil Code § 1798.100, et seq. (the “CCPA”). In accordance with the CCPA, during the twelve months since we last updated this Privacy Notice, we may have:
1. Collected the following categories of personal information about you:
Identifiers such as name, username, alias, shipping address, unique personal identifiers (such as pixels, cookies, web beacons), IP address, email address, phone number, customer number, information obtained from identification cards, bank account information, financial information, or other similar identifiers;

(c) From our third-party vendors, merchants, and service providers that help us run our business such those that we use to fulfill orders, provide logistics, process your payments, verify your information, provide analysis and analytics, maintain our directories and databases, administer and monitor emails and marketing, administer and send emails, newsletters and ads, and provide consulting services.

(l) Verifying and validating your identity or otherwise preventing, investigating fraud, unlawful, unauthorized or criminal activity, or unauthorized access to or use of personal information, our websites or data systems;
(m) Enabling you to interact with service providers, whether by linking to their sites or allowing the viewing of their content within our online environment or content within their online environment

(a) Service providers such as IT vendors, cloud computing providers, providers of online business and ecommerce platforms; background applications, database providers, customer service vendors and other service providers that need access to such information to perform services for us;

Right to Opt-out of Sale of Personal Information
The CCPA gives consumers the ability to direct a business not to sell their personal information to a third party. We do not sell your personal information, and therefore this requirement does not apply to us. As detailed herein, we and our service providers only use personal information to the extent necessary to perform our normal business operations and help us communicate with and understand our customers.
California Consumer Privacy Rights
California residents have the right to request that we disclose the categories of personal information collected; the categories of sources from which personal information is collected; the business or commercial purpose; the categories of third parties with which the businesses shares personal information, and other information we may have about you. Similarly, California residents can request that we delete certain pieces of their personal information, excluding aggregated non-identifiable information that we collect to improve our services. You may submit a written request to privacy@bragg.com. After you (or an agent which you authorize) submit a request to access or delete your personal information, we are required to “verify” that your request is not fraudulent. Thus, upon receiving your request, we may use various verification methods to verify the request as the circumstances dictate.
We reserve the right to deny your deletion request if we determine that retaining the information is necessary for us or our service provider(s) to: attend to pending or future legal disputes; keep our websites and systems secure and identify and repair errors that impair site functionality; maintain appropriate business and financial records; complete the transaction for which we collected the personal information or otherwise perform our contract with you; detect or protect against fraudulent, or illegal activity, or prosecute those responsible for such activities; ensure the right of free speech; comply with a legal obligation; or make other internal and lawful uses of that information.
Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not: Deny you goods or services; charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; or provide you a different level or quality of goods or services.
Do Not Track Signals: Our systems do not recognize "Do Not Track" signals to the extent received from a web browser.
If you have any questions or complaints regarding this Notice, our global privacy standards or our handling of personal data, you can contact the Bragg’s Privacy Team by email to privacy@bragg.com (contacting privacy@bragg.com will connect you with those at Bragg who are responsible for the handling of personal data, which includes our appointed data protection officer in your country, if applicable).
Your personal information may be transferred to and/or maintained on computers located outside of your state, county, country, or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. The personal information we collect is stored and/or processed in the United States, or where we or our partners, affiliates, and third-party providers maintain facilities. The countries to which we store, process, or transfer your personal information may not have the same data protection laws as the country in which you initially provided the information. If we transfer your personal information to third-parties in other countries: (i) we will perform those transfers in accordance with the requirements of applicable law; and (ii) we will protect the transferred personal information in accordance with this Privacy Policy.
Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
Security of Data
The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
